Privacy Policy
This Privacy Policy describes how Creative Care Therapy Services d/b/a Creative Care ABA Therapy (“Creative Care,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects personal information that we receive through the website at creativecareaba.com (the “Website”), through phone calls, through email, through text messages, and through related communications. It also explains your rights and the choices you have about your personal information.
This Privacy Policy applies to information we receive in connection with the Website and general business communications. Information we receive about your child in the course of delivering ABA clinical care is also governed by our clinical Notice of Privacy Practices and applicable state and federal healthcare privacy laws, which are provided to you at intake.
1. Information we collect
1.1 Information you provide
We collect information you give us directly when you use a form, request a consultation, send an email, place a call, or reply to one of our text messages. Depending on the interaction, this may include:
- Your name, email address, mailing address, city, ZIP code, and phone number.
- Information about your child relevant to ABA care, such as the child’s first name, age or date of birth, school, and a summary of what you are looking for. Do not submit clinical records, diagnoses, or sensitive medical files through public forms; we will collect those securely at intake when needed.
- The name of your insurance carrier and high-level plan details.
- Any message or notes you choose to add to a form, email, or call.
- Records of consent (for example, the time and source of your form submission).
1.2 Information collected automatically
When you use the Website we automatically receive technical information that browsers and servers exchange in the normal course of operation, including:
- Your IP address, approximate location derived from that IP address, browser type and version, operating system, device type, language preference, and referring URL.
- Pages you visit, the time of each request, and how you interact with the Website (clicks, scrolls, form starts, and form submissions in aggregate).
- Cookies and similar technologies (see Section 6). We use a small number of cookies for essential site operation and for aggregate analytics.
- Logs maintained by our hosting and security providers (Cloudflare) for performance, reliability, and abuse prevention. These logs are retained on a rolling basis.
1.3 Information from third parties
We may receive limited information from service providers that help us operate the Website and our communications, such as our email-delivery provider, our SMS-platform provider, our hosting provider, and our spam-prevention provider (Cloudflare Turnstile). These providers process information on our behalf under written agreements that limit their use of the information to the services they provide to us.
2. How we use information
We use the information we collect to:
- Respond to your inquiry and route it to the right person on our team.
- Schedule consultations, send appointment reminders, and coordinate clinical intake.
- Verify whether we serve your address and check insurance benefits at a high level.
- Provide service updates and reasonable follow-up about your inquiry or your child’s care.
- Improve the Website, monitor performance, prevent fraud and abuse, and protect the security of our systems and our users.
- Comply with legal, regulatory, accreditation, and audit obligations.
- Defend our legal rights, enforce our Terms of Service, and respond to lawful requests from public authorities.
We do not sell personal information for monetary or other valuable consideration. We do not use your personal information for cross-context behavioral advertising. We do not use information collected from public website forms to train any third-party machine-learning model.
3. Mobile information and SMS messaging
This section is provided in addition to, and does not replace, our overall practices described elsewhere in this Privacy Policy. It describes how we treat mobile information (including your mobile phone number, opt-in records, and the contents of text exchanges) when you participate in our SMS messaging program.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All other categories of mobile information sharing are excluded from this consent. Information may be shared with subcontractors that support the messaging program (such as our SMS-platform provider, our hosting provider, and our customer-relationship system), solely so they can deliver the program on our behalf and under written agreements that restrict their use of the information.
By providing your mobile number through any Creative Care form, by checking a text consent box, by texting us first, or by replying to a Creative Care text, you consent to receive text messages from Creative Care related to intake, scheduling, appointment reminders, clinical coordination, billing, service updates, and reasonable follow-up about your inquiry or your child’s care. Consent to receive text messages is not a condition of receiving services from Creative Care.
- Message frequency varies based on your interaction with us.
- Message and data rates may apply from your mobile carrier.
- Reply HELP for help.
- Reply STOP to opt out of further messages at any time.
- Carriers are not liable for delayed or undelivered messages.

4. How we share information
We share personal information only in the following circumstances:
- Service providers. With vendors and contractors who help us run the Website, deliver email and SMS, host data, prevent abuse, store records, accept payments, or operate our practice. They may access information only as needed to perform their services and are contractually required to protect it.
- Within Creative Care. Among employees and clinicians who have a legitimate need to access the information for the purposes described in Section 2.
- With your direction. When you ask us to share information with a third party (for example, a school district, an insurance carrier, or a referring provider) and provide the necessary authorization.
- Legal and safety. When required by law, regulation, court order, subpoena, or government request; or when we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Creative Care, our clients, our staff, or the public.
- Business transfers. In connection with a merger, acquisition, reorganization, financing, sale of assets, or similar transaction, in which case information may be transferred subject to commercially reasonable confidentiality commitments.
We do not sell or rent personal information.
5. Children’s privacy
The Website is intended for adults 18 years of age or older. We do not knowingly collect personal information directly from children under 13 through the Website. Information you submit about a child is provided by you (the parent, legal guardian, or authorized adult) on the child’s behalf, and you represent that you have the legal authority to provide it.
If we learn that we have inadvertently collected personal information directly from a child under 13 through the Website without the appropriate consent, we will delete that information promptly. Parents and guardians who believe a child under 13 has submitted information to the Website without authorization can contact us at office@creativecareaba.com, and we will investigate.
6. Cookies and similar technologies
We use a limited set of cookies and similar technologies to operate the Website and understand aggregate usage. Cookies fall into the following categories:
- Strictly necessary. Required for the Website to function (for example, security, abuse prevention, and form submission). These cannot be turned off without breaking the Website.
- Analytics. Help us understand how visitors find and use the Website in aggregate so we can improve content and navigation. Analytics cookies do not identify you personally.
Most browsers let you refuse or delete cookies through their settings. If you disable cookies, parts of the Website may not work properly. We do not currently respond to browser “Do Not Track” signals because there is no industry-standard definition of how to do so.
7. Data retention
We keep personal information only as long as we need it for the purposes described in this Privacy Policy or as required by law. In practice:
- Inquiry information from contact and intake forms is retained while we evaluate your inquiry and for a reasonable follow-up period, then archived or deleted in accordance with our records-retention schedule.
- Records related to clinical care are retained as required by applicable healthcare laws and our professional obligations.
- SMS opt-in records, opt-out records, and message logs are retained as required to demonstrate consent and to comply with messaging-program rules.
- Server logs are retained on a rolling basis for performance, security, and abuse prevention.
- We may retain limited information indefinitely when required for legal, compliance, audit, or dispute-resolution purposes.
8. How we protect information
We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encryption in transit, access controls, workforce training, vendor due diligence, and monitoring. No system is perfectly secure, however, and we cannot guarantee the security of any information you transmit to us. You are responsible for maintaining the security of any device or account you use to access the Website.
If we become aware of a security incident affecting your personal information, we will notify you and the appropriate authorities as required by applicable law.
9. Your choices and rights
Depending on where you live, you may have rights regarding your personal information, including the rights to:
- Request access to the personal information we hold about you.
- Request correction of inaccurate or incomplete information.
- Request deletion of personal information, subject to legal and clinical-recordkeeping obligations that may require us to keep certain records.
- Withdraw consent to communications, including SMS and non-essential email.
- Opt out of cookies that are not strictly necessary, through your browser settings.
- Receive a copy of certain information in a portable format, where required by law.
- Lodge a complaint with a data-protection authority where one applies to you.
To exercise any of these rights, contact us at office@creativecareaba.com. We will verify your identity before responding and will reply within the timeframes required by applicable law. We will not discriminate against you for exercising a privacy right.
California residents: You may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what categories of personal information we collect, sell, or share; the right to delete; the right to correct; and the right to opt out of the sale or sharing of personal information. We do not sell personal information and we do not share personal information for cross-context behavioral advertising.
10. International users
The Website is operated in the United States and is intended for users in the United States, primarily in New Jersey, Maryland, and Delaware. If you access the Website from another country, you understand that your information will be transferred to and processed in the United States, where data-protection laws may differ from those of your country.
11. Third-party links
The Website may link to third-party websites, products, and services (for example, Google Maps on location pages or social media platforms). We are not responsible for the privacy practices of those third parties. When you leave the Website, we encourage you to read the privacy policies of every site you visit.
12. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page and, when changes are material, provide additional notice (for example, by posting a banner on the Website or by sending an email to recent contacts). Your continued use of the Website after the updated Privacy Policy takes effect constitutes acceptance of the updated Privacy Policy.
